These Disclaimers apply to the LUCERARO website located at www.luceraro.com and its subsidiaries, affiliates, and related pages (collectively, the “Site”). These Disclaimers supplement, and are incorporated into, our Terms of Service. If there is any conflict between these Disclaimers and our Terms of Service, the Terms of Service shall control, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

1. General Disclaimer

The Site, its content, and all products and services made available through the Site are provided on an “as is” and “as available” basis. LUCERARO makes no representation or warranty of any kind, express or implied, regarding the operation of the Site, the accuracy or completeness of any information on the Site, or the products or services offered through the Site.

Your use of the Site is at your sole risk. You are solely responsible for any consequences arising from your access to or use of the Site.

2. Intellectual Property & Fair Use

All content on this Site, including designs, text, logos, images, graphics, product photography, software, and other materials, is the property of LUCERARO or its licensors and is protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.

Our products are the result of LUCERARO’s own design and development efforts. While some designs may be inspired by classic, contemporary, or traditional jewelry styles, they are original creations of LUCERARO and are not replicas, counterfeits, or unauthorized copies of any other brand’s products.

You may not copy, reproduce, distribute, modify, republish, sell, or exploit any content from this Site without our prior written permission. You may not use any LUCERARO trademark, logo, product name, or service name in any metatags, hidden text, or similar manner without our prior written consent.

3. Product Information & Limitations

a. Descriptions and Images

We strive to present accurate product information, including descriptions, specifications, dimensions, and images. However, slight variations in color, texture, clarity, brightness, or dimensions may occur due to photographic lighting, monitor settings, device display differences, or natural material characteristics. The actual product may differ slightly from the images shown on the Site.

Products may appear larger or smaller than their actual size. Color and appearance may vary depending on your screen and lighting conditions.

b. Design Language and Originality

When we use terms such as “inspired by,” “in the style of,” or “compatible with,” such language indicates a design philosophy, aesthetic influence, or functional compatibility only. It does not mean that our product is an original, licensed, authorized, or affiliated product of another brand. All products are sold under the LUCERARO brand and are covered solely by LUCERARO’s applicable policies and warranties, if any.

c. Customization, Availability, and Order Approval

All customizations, including size, finish, engraving, and made-to-order requests, are subject to our manufacturing capabilities and approval. We reserve the right to limit quantities, discontinue products, or refuse or cancel orders at any time in our sole discretion.

Availability is not guaranteed until your order has been processed and approved by LUCERARO. Receipt of an order confirmation does not mean your order has been accepted. If an item is out of stock or unavailable, we may contact you with available options or cancel the order and issue a refund for amounts collected for the cancelled item(s).

d. Diamond, Gemstone, and Pearl Measurements

In compliance with industry standards and applicable regulations, total carat weight may vary by up to 0.05 carats from the stated weight. For gemstone and pearl measurements, a tolerance of 0.25mm is allowed.

For diamond jewelry set with multiple diamonds, we provide the minimum total carat weight for the piece. Color and clarity grades are expressed as either a minimum or an average depending on the number of diamonds. If stated as a minimum, all diamonds in the piece are at or above the stated quality. If expressed as an average, collectively the quality is equal to or exceeds the grade stated.

e. Diamond Certificates and Origin Information

Customers who purchase lab-grown diamonds with GIA or IGI grading reports will receive the original physical certificate with their purchase, unless otherwise stated. These grading reports are important documents and are expensive to replace. If you return a diamond without the original grading report, you will be charged a replacement fee of one hundred and fifty dollars ($150.00), as further described in our Refund Policy.

Natural diamond origin information, whether provided on this Site, in marketing materials, in materials provided to any purchaser, or elsewhere, is provided without any warranty of any kind, express or implied. Origin information is based on information supplied by our suppliers and our chain-of-custody protocol. While we make reasonable commercial efforts to ensure accuracy, we cannot guarantee or warrant such information.

All representations regarding gemstone origin, repurposed content of precious metals, and estate information are provided to the best of LUCERARO’s knowledge and without guarantee or warranty of any kind.

f. No Investment or Appraisal Advice

Nothing on this Site constitutes investment, financial, appraisal, or resale advice. Diamond, gemstone, and jewelry values may fluctuate based on market conditions, grading, demand, and other factors. LUCERARO does not guarantee any future value, resale value, or investment return for any product.

4. Return, Exchange, and Promotional Limitations

Returns, exchanges, and resizing are subject to our Refund Policy. In general:

  • Eligible items may be returned within 30 days of the shipment date.

  • Exchanges are available within 60 days of the shipment date for eligible standard ring sizes and styles.

  • Return shipping is paid by LUCERARO.

  • Engraved items cannot be returned, exchanged, or resized.

  • Fully custom-made or bespoke products cannot be returned or exchanged.

  • Missing lab-grown diamond certificates are subject to a $150 replacement fee per missing certificate.

  • We do not allow multiple pieces to be purchased for comparison. Buying several items with the intent of keeping only the one you prefer and returning the rest is not permitted and is not covered by our return policy.

  • Exchanges must be for an item of equal or greater value than the original purchase price. Exchanges for lower value are not permitted; if the exchange value is higher, the difference will be charged to the customer.

5. Disclaimer of Warranties

To the fullest extent permitted by applicable law, LUCERARO disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as to the Site, its content, and any products or services offered through the Site.

LUCERARO does not warrant that the Site, its servers, or electronic communications are accurate, reliable, complete, current, secure, or free of viruses or other harmful components. We do not warrant that any errors or defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. Nothing in these Disclaimers limits any rights you may have under mandatory consumer protection laws in your jurisdiction.

6. Limitation of Liability

To the fullest extent permitted by applicable law, LUCERARO, its directors, members, employees, affiliates, agents, service providers, and any other party involved in creating, producing, or delivering LUCERARO products or services shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of use, or business interruption, arising out of or in connection with your use of the Site, any products or services, or any content accessed through the Site.

Our total cumulative liability to you for any and all claims arising from your use of the Site or products shall not exceed the total amount you paid to LUCERARO for the product(s) giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. Nothing in these Disclaimers excludes or limits liability that cannot be excluded or limited under applicable law.

7. Indemnification

You agree to defend, indemnify, and hold harmless LUCERARO, its affiliates, and their respective directors, officers, employees, agents, contractors, and service providers from and against all claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees and court costs, arising out of or relating to:

  • Your breach of these Disclaimers or our Terms of Service;

  • Your access to or use of the Site;

  • Your violation of any law or the rights of any third party; or

  • Any content you submit, post, or transmit through the Site.

8. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources, including payment processors, shipping carriers, and marketing partners. Such links do not constitute sponsorship, endorsement, or approval by LUCERARO of the linked site, service, or its content, policies, or practices.

LUCERARO is not responsible for the availability, content, security, policies, or practices of any third-party site or service. Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by these Disclaimers or our Privacy Policy. We encourage you to review the privacy policies and terms of any third-party site you visit.

9. Jurisdiction, Dispute Resolution, and International Users

These Disclaimers are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles. 

Any disputes, claims, or controversies between you and LUCERARO shall be resolved in accordance with our Terms of Service, including any applicable jury trial waiver, class action waiver, or other dispute resolution provisions, except where prohibited by the mandatory laws of your country or state of residence.

We acknowledge and comply with applicable mandatory consumer protection laws in the jurisdictions in which we operate, including for customers in the European Union, the United Kingdom, and other regions. Nothing in these Disclaimers is intended to exclude, restrict, or waive any consumer rights that cannot be excluded, restricted, or waived under applicable law.

Statements on this Site regarding future product launches, features, collections, company goals, or business plans are “forward-looking statements.” These statements are based on current expectations and are subject to risks, uncertainties, and changes that may cause actual results to differ materially. LUCERARO undertakes no obligation to update any forward-looking statements, except as required by law.
